1. Acceptance of Terms

1.1 By using this real-time translation software (hereinafter referred to as the "Service"), you agree to comply with all terms and conditions of this User Agreement.

1.2 If you are using this Service on behalf of an organization, you also confirm that you have the authority to accept these terms on behalf of that organization.

2. Service Description

2.1 This Service provides real-time voice translation capabilities designed to facilitate cross-language communication in daily life scenarios, such as travel or living abroad.

2.2 Service Limitations:

  • The Service requires an internet connection and does not support offline use
  • Translation results are provided for reference only and may contain errors or inaccuracies
  • The Service is NOT intended for and should NOT be used in professional or specialized contexts, including but not limited to: medical consultations, legal proceedings, financial investments, business negotiations, or any other situations requiring highly accurate translations

2.3 Service Availability:

  • The Service is available to users in all countries and regions where Apple App Store is accessible
  • Users must ensure their devices meet the minimum system requirements as published on the App Store

3. User Accounts

3.1 Certain features may require the creation of a user account. You are responsible for maintaining the security of your account.

3.2 You agree to provide accurate, complete, and up-to-date registration information.

3.3 User Data Storage:

  • Voice inputs are processed in the cloud but not permanently stored
  • Speech recognition results are stored locally on your device
  • Registered users' basic information is stored on servers located in the United States
  • We only send essential service notifications and do not use user information for marketing purposes

4. User Behavior and Content

4.1 You agree not to use the Service for any illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise inappropriate activities.

4.2 You are solely responsible for all content transmitted or translated through the Service.

4.3 We reserve the right, but have no obligation, to monitor, edit, or remove any inappropriate content.

5. Privacy and Data Processing

5.1 Data Collection and Processing:

  • Voice inputs are temporarily processed in our cloud servers to provide translation services
  • We do not permanently store or retain any voice recordings
  • Speech recognition and translation results are stored locally on your device
  • Account-related information is stored on servers located in the United States

5.2 Data Usage Limitations:

  • Cloud processing of voice inputs is solely for providing real-time translation services
  • User data will not be used for marketing purposes
  • We do not share users' personal information with third parties unless required by law

5.3 We may use anonymized data to improve our services.

6. Intellectual Property

6.1 This software and all related intellectual property rights belong to us or our licensors.

6.2 You retain all rights to your content translated through the Service.

6.3 You grant us a worldwide, royalty-free license to use, store, and process your content to provide the Service.

7. Disclaimer and Limitation of Liability

7.1 Service Disclaimer:

  • Translations provided by the Service are for reference only and accuracy is not guaranteed
  • Users understand and agree not to rely on the Service for professional contexts (such as medical, legal, or financial situations)
  • We shall not be liable for any misunderstandings, miscommunications, or consequential damages arising from the use of this Service
  • We shall not be responsible for any direct or indirect losses resulting from reliance on the translation results

7.2 Service Interruption:

  • In the event of service interruption, affected users will be compensated with additional service time equivalent to the duration of the interruption
  • Compensation will be applied automatically to eligible user accounts

7.3 The Service is provided "as is" without any express or implied warranties.

8. Payment and Refunds

8.1 Payment Processing:

  • All payments are processed through Apple App Store
  • Pricing is displayed in the App Store and primarily charged in US dollars
  • Users are subject to Apple's payment terms and conditions

8.2 Refund Policy:

  • All refund requests must be submitted through Apple App Store
  • Refund eligibility and processing are governed by Apple's refund policies
  • Billing disputes will be handled according to Apple App Store's dispute resolution procedures

9. Service Changes and Termination

9.1 We may perform system updates and maintenance at any time without prior notice.

9.2 While we strive to minimize disruption, we do not guarantee specific maintenance schedules or update timelines.

9.3 We reserve the right to modify, suspend, or terminate the Service at any time without prior notice.

9.4 We may terminate your account for violation of this Agreement or prolonged inactivity.

10. Applicable Law and Dispute Resolution

10.1 This Agreement is governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

10.2 Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in accordance with the Wyoming Uniform Arbitration Act (Wyo. Stat. § 1-36-101 et seq.).

10.3 The arbitration shall take place in Wyoming, United States. If you do not reside in Wyoming, the arbitration may be conducted telephonically or via video conference, unless we mutually agree otherwise.

10.4 You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.

10.5 Notwithstanding the foregoing, either party may seek injunctive or other equitable relief to protect its intellectual property rights in any court of competent jurisdiction.

11. Agreement Modifications

11.1 We reserve the right to modify this Agreement at any time. The modified agreement will be posted within the Service.

11.2 Continued use of the Service indicates your acceptance of the modified terms.
